The Intellectual Property Practice Group handles the registration, protection and enforcement of our client’s intellectual property rights under Puerto Rico and United States copyright and trademark laws. The IP Practice Group assists clients in determining whether a name, trade dress or copyright warrants protection. It also drafts appropriate documentation for others to use such intellectual property rights, such as the case of sponsorship agreements and licensing agreement.
The IP Practice Group has paralegals who with attorney supervision are dedicated exclusively to the filing and registration of trademarks, trade names, service marks and copyrights in the Puerto Rico and United States Patent and Trademark offices. Our lawyers directly handle all administrative filings of opposition and notices of corrections as may be required by the Puerto Rico and United States Patent and Trademark offices.
Some members of the IP Practice Group are also members of our Litigation Department, and as such assist clients in enforcing their IP rights against infringement, including the assertive and diligent filing of injunctions at the local and federal courts seeking temporary and immediate relief so that the client’s goodwill is less affected by the third party’s illegal actions. Litigation in this area tends to be complex, and our team has the experience and knowledge needed to handle the various phases of litigation, including negotiation.
The IP Practice Group is a member of European alliances and has close contact with intellectual law practitioners in other areas of the World that allows us to process our clients filing and protect our clients’ marks in such countries, thus working with our clients for the protection of marks on a global basis. The IP Practice Group also coordinates for our clients the protection and enforcement of intellectual property in foreign jurisdictions by retaining and working closely with the most qualified attorneys in such jurisdictions.
