Puerto Rico Employee Benefits Attorney

At GAC, lawyers from our Employee Benefits Practice Group assist businesses and not-for-profit organizations in designing and administering employee benefit plans. Our attorneys have extensive experience with the federal Employee Retirement Income Security Act (ERISA), other federal laws and laws of Puerto Rico governing employee benefit plans including but not limited to the Puerto Rico Internal Revenue Code of 1994, as amended.

Our attorneys advise plan trustees and fund administrators and assist our clients with ERISA-related matters, handling the drafting, qualification, administration and correction of employer-sponsored qualified and nonqualified benefits plans to assure compliance with Puerto Rico and federal regulations. The attorneys also manage and/or prepare documentation relating to taxation and reporting of federal and state income taxes and coverage under the Federal Insurance Contributions Act, the Federal Unemployment Tax Act and other state disability and unemployment programs.

In order to provide comprehensive legal services that address our clients’ issues from a broad perspective, members of the Employee Benefits Practice Group may work with members of our other practice groups on related issues:

  • Audits by the IRS or Puerto Rico tax authorities
  • Litigation involving complex ERISA issues or claims involving allegations of breach of fiduciary duty or wrongful denial of benefits
  • Merging plans
